INVITATION TO TENDER FOR GOODS, WORKS, CONSULTANCY SERVICES AND NON-CONSULTANCY SERVICES

a. INTRODUCTION
1.1 The Federal Ministry of Health & Social Welfare is saddled with the responsibility of developing and implementing policies that strengthen the national health system for effective, efficient, accessible, and affordable delivery of health services, in partnership with other stakeholders. It is in line with this that the FGN allocated funds for the implementation of different projects to actualize its mandate and render effective healthcare services to the Nigerian populace.
1.2 To this end, the Federal; Ministry of Health and Social Welfare (FMH & SW) is soliciting for bids from eligible suppliers, contractors, service providers with reputable experience, and track record to submit bids and expression of interest (EOI) for the following projects:

C. ELIGIBILITY REQUIREMENTS :
Prospective bidders are required to submit the following documents:
a. Evidence of certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including forms cac1.1 or CAC2 and CAC7; Business name with Form BN 1 is also acceptable for consultancy services;
b. Evidence of Company’s Income Tax Clearance Certificate (or personal income tax clearance certificates of all the partners in case of business name) for the Last three (3) years valid till 31st December, 2024;
For category A and B, bidders shall present minimum average annual turnover of N30million while for category C projects, bidders shall present minimum average annual turnover of N70million only in their TCC.
c. Evidence of pension Clearance Certificate for the Last three (3) years (this requirement is only applicable to bidders whose number of staffs is 15 and above);
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate Valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is ₦50Million and above);
e. Evidence of Nigerian social Insurance Trust Fund (NSITF) Clearance Certificate Valid till 31st December 2024;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP;
g. Sworn Affidavit:
- Disclosing whether or not any officer of the relevant committees of the federal ministry of health or Bureau of Public Procurement is a former or present Director, Shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
- That no partner/Director has been convicted in any country for any criminal offence relating to fraud of financial impropriety or criminal misinterpretation or falsification of facts relating to any matter;
- That the company does not at the time of this bid have any existing loan or financial liability with a bank, other financial institutions or third party that is classified doubtful, non-performing, bad or whose payment portion has been outstanding for the last three months;

h. Company’s Audited Accounts for the last three (3) years -2021,2022,2023;
i. Reference letter from a reputable commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Verifiable documentary evidence of awards, Valuation Certificates, Job Completion Certificates and photographs of the project evidence of at least three (3) similar jobs executed in the last five (5) years including letters;
k. Consultancy services: evidence of firm’s current registration with relevant regulatory professional body (ies) such as NITDA & CPN for ICT, EHORECON for cleaning/fumigation, CMD for training, ICAN, ANAN for financial services, NEMSA for electricity;
l. Company’s profile with the Curriculum Vitae of key Staff to be deployed for the project, including copies of their Academic/ Professional qualifications
m. Works: List of Plants/Equipment with proof of Ownership/Lease Agreement;
n. For supply of equipment: letter of authorization as representative of the original equipment manufacturers (OEMs);
o. For joint Venture/ Partnership, Memorandum of Understanding (MoU) indicating lead Partner should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner);

Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Headed Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM NO.) and e-mail address. The Letter head Paper must bear the names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.
d. Collection of tender documents (Category a & B)
Tender documents are obtainable from the office of the director procurement room 306, 3rd floor upon the presentation of evidence of payment of nonrefundable tender fee of N10, 000.00 per lot, paid into the federal ministry of health’s TSA in any reputable commercial bank in Nigeria.

e. SUBMISSION OF TENDER DOCUMENTS (CATEGORY A & B)
Prospective bidders are to submit bids in two (2) hard copies each of the technical and financial bids with soft copy of financial bid only in MS Excel format, packaged separately in sealed envelopes and clearly marked as “technical; bid” or “financial bid”. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to the permanent secretary, Federal Ministry of Health, federal secretariat complex, phase III, 3rd floor(ministerial tender board secretariat, Ahamdu Bello Way, Abuja and clearly marked with the lo bided for. Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and dropped in the designated tender box at the tender secretariat, room 306, 3rd floor, Federal Secretariat, phase III, Ahamdu Bello Way, Central Business District, Abuja not later than on or before 12:000 noon Monday, 16th September 2024

f. SUBMISSION OF EOI (SERVICES) & PREQUALIFICATION (CATEGORY C & D)
Interested firms are to submit two (2) bound pre-qualification documents/EOI for each of the lot desired, the prequalification document/EOI should be submitted in a a sealed envelope and addressed as indicated above and submitted not later than 12:00 noon, Monday, 2nd September, 2024.

g. OPENING OF EOIS, PREQUALIFICATION DOCUMENTS & TECHNICAL BIDS
The EOIs/prequalification documents and the technical bids will be opened immediately after the deadlines for submission at 12:00 noon Monday, 16th September, 2024, respectively, at the venue stated above while the financial bids will be kept un-opened, ensure that you sign the bid submission register as the federal ministry of health & social welfare will not be held liable for misplaced or wrongly submitted bids.

8. GENERAL INFORMATION
a. EOIs/Bids must be in English Language and signed by an official authorized by the bidder;
b. EOIs/Bids submitted after the deadline for submission would be returned un-opened;
c. Bidders should not bid for more than two (2)lots;
d. All costs will be borne by the bidders.
e. The EOIs/Technical Bids will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and Private Professional bodies; and will be covered by video recording; invitation link will be sent to bidder who chooses to join the bid opening online;
f. Bid documents can also be collected in soft copies and bidder can submit through post (courier services);
g. Goods and Works: Only pre-qualified bidders at the technical evaluation will be invited at a later date for financial bids opening, while the financial bids of un-successful bidders will be returned un-opened.
h. services: only shortlisted applicants will be invited at a later date for collection of request for proposals;
i. pre-qualification: only pre-qualified bidders will be invited at a later date for collection of request for proposal;
j. Duplicate bids of LOT by a company shall be rejected except a written notification is made before the bid opening date and addressed to permanent secretary, FMoH. Please ensure that the second bid carries a labeled as “corrected bid”.
k. The federal Ministry of Health & Social Welfare is not bound to pre-qualify any bidder and reserves the right to annul the procurement process at any time without incurring any liabilities in accordance with Section 28 of the Procurement Act, 2007.
